This Privacy Policy ("Policy") explains how Wizcart Inc. and its affiliated entities (collectively, "Wizcart," "we," "us," or "our") collect, use, disclose, and protect the personal information of individuals who use our e-commerce service marketplace (the "Platform") and related services (collectively, the "Services"). Wizcart is committed to transparency and to safeguarding the privacy of our users in compliance with applicable data protection laws in the United States of America (USA), Canada, and India. Data privacy is a cornerstone of customer trust and business success, and this Policy outlines our practices to uphold that commitment. We aim to provide clear and understandable information about how your personal data is handled.

Scope (Who This Policy Applies To)

This Policy applies to all individuals who access or use the Wizcart Platform and Services, including:

  • Customers: Individuals or entities seeking or booking services through the Platform.
  • Service Providers: Individuals or businesses offering their services through the Platform, including their employees or authorized representatives whose information might be processed in connection with the Services.
  • Website/Platform Users: Any individual browsing or interacting with the Wizcart website or mobile applications, even if not registered as a Customer or Service Provider.
Acceptance of the Policy

By accessing or using Wizcart's Services, you acknowledge that you have read, understood, and agree to the terms of this Privacy Policy and our Terms of Service. If you do not agree with our policies and practices, please do not use our Services. This Policy constitutes a legally binding agreement between you and Wizcart.

Definitions

For the purposes of this Policy, the following terms have the meanings ascribed to them: Personal Information, Customer, Service Provider, User, Data Principal, Data Fiduciary, Data Processor, Processing, and Platform, as commonly defined in CCPA/CPRA, PIPEDA, Quebec Law 25, and India's DPDP Act.

2. Information We Collect

Wizcart collects various types of personal information from and about users of our Platform and Services. The specific types depend on your interaction with us.

2.1. Information from Customers
  • Account Registration & Profile Information: Name, email, phone, address, password.
  • Service Request Details: Service type, preferred date/time, location, instructions.
  • Payment Details: Processed by secure third-party processors; Wizcart may retain limited details (e.g., last four digits, transaction IDs) for records.
  • Communications: Support interactions and, with notice, platform-facilitated communications.
  • Reviews and Ratings and optional demographic info you provide.
2.2. Information from Service Providers
  • Individual and business details for verification and payouts (e.g., licenses, tax IDs, banking info).
  • Qualifications, experience, portfolios; background check data (with consent, where permitted).
  • Employee data (if a business) limited to what is necessary for Platform functionality.
  • Insurance information relevant to services provided.
2.3. Information from All Users
  • IP address, cookies and tracking technologies, device information, geolocation (with consent), and log data.
2.4. Methods of Data Collection
  • Directly from users; automatically via cookies and logs; and from third parties (payment processors, background check providers, social sign-in, analytics partners, and publicly available sources).

Sensitive Personal Information: Collected only where necessary, with explicit consent or as permitted by law.

3. How We Use Your Information

  • Facilitating bookings and connections between Customers and Service Providers.
  • Processing payments and commissions via third-party processors.
  • Account management and support, including service communications.
  • Platform improvement and personalization based on usage data and preferences.
  • Managing Service Provider employees where applicable (as a processor on behalf of the business).
  • Safety and security, including fraud prevention and, with notice, monitoring platform communications.
  • Legal compliance and dispute resolution.

4. How We Share and Disclose Your Information

  • Between Customers and Service Providers to fulfill bookings.
  • With third-party payment processors (e.g., PCI DSS-compliant providers).
  • With analytics and marketing providers (de-identified where possible; with consent where required).
  • With background check providers (for Service Providers, with consent).
  • With legal and regulatory authorities as required by law.
  • Regarding Service Provider employee data to the employing business for management via the Platform.
  • For business transfers (mergers, acquisitions) with notice.
  • With affiliates and business partners (with consent where required).

All sharing is governed by appropriate contracts and safeguards limiting use and ensuring security.

5. Data Security

We implement technical, administrative, and physical measures to protect personal information, including:

  • Encryption (TLS/SSL), firewalls, intrusion detection/prevention, secure infrastructure.
  • Access controls, training, data minimization, incident response, vendor due diligence, and audits.
  • Physical access restrictions where applicable.

In the event of a data breach posing risk, we will notify affected users and regulators as required by law. Users should safeguard their account credentials and notify us of any suspected unauthorized access.

6. Your Rights and Choices

Depending on your jurisdiction, you may have rights to access, correct, delete, restrict, port, or object to processing of your personal information; withdraw consent; and seek grievance redressal (India). We will not discriminate for exercising these rights.

To exercise rights, contact us as described in Section 11. We will verify requests and respond within legally required timeframes.

7. Cookies and Other Tracking Technologies

We use essential, performance/analytics, functionality, and targeting/advertising cookies. You can manage preferences via our consent tool and browser settings. Non-essential cookies require consent where mandated (e.g., Quebec Law 25).

We currently do not respond to Do Not Track signals, but honor legally recognized opt-out signals (e.g., Global Privacy Control) where required.

8. International Data Transfers

Your data may be transferred, stored, and processed outside your country. We implement appropriate safeguards (e.g., contractual clauses, PIAs for Quebec residents, PIPEDA accountability, DPDP compliance) to ensure comparable protection.

Where explicit consent is required for transfers, we will obtain it.

9. Children's Privacy

The Platform is intended for users 18+. We do not knowingly collect data from individuals under 18 without required parental consent. If such collection is discovered, we will delete it promptly.

10. Changes to This Privacy Policy

We may update this Policy. Material changes will be communicated (e.g., email, in-app notices). Continued use after the effective date constitutes acceptance.

  • Canada: PIPEDA (Ten Fair Information Principles) and Quebec Law 25 (consent, PIAs for cross-border transfers, privacy by default, portability).
  • India: DPDP Act (consent/legitimate uses, rights to access/correct/erase, grievance redressal, children’s data protections, cross-border transfer compliance).
